Local Lettings Plan

January 2012

Background

This local lettings plan was developed by Dales Housing Ltd and Derbyshire Dales District Council. The development at Weston Bank, Marston Montgomery, was handed over to Dales Housing on 25 March 2011. The aim of the development was to provide family accommodation to residents from within the area or immediately adjacent parishes.

Permission for the development was approved by the Planning Committee with a strict Local Lettings Plan (LLP) agreed at planning stage. The Local Lettings Plan aims to give opportunities for local families to be re-housed within the area and also outside the normal Home-Options Policy eligibility criteria.

Revised Local Lettings Plan

The initial LLP has been reviewed and amended from January 2012. The conditions of the revised LLP are as follows:

The affordable dwellings hereby approved shall only be occupied by persons that satisfy the following definition of “local need”:
a) People residing continuously for a period of not less than five years out of the previous ten years in Marston Montgomery Parish and currently living in accommodation that is overcrowded or otherwise unsatisfactory, OR
b) People residing continuously for a period of not less than five years out of the previous ten years in Marston Montgomery parish and forming a household for the first time, OR
c) People who are related to a resident of the Marston Montgomery parish, or are not now resident in Marston Montgomery, but who have resided continuously within the Marston Montgomery Parish for more than ten years out of the previous twenty years, OR
d) People who have an essential need arising from age or disability to live close to other people who have lived continuously within the Marston Montgomery parish for more than five years out of the previous ten years, OR
e) People who have an essential need to live close to their work in the Marston Montgomery parish.

Initially the household eligibility criteria within the Home-Options Policy will be applied and adhered. However if there is no demand from households within that criteria, consideration can be given to those households that would normally be in-eligible and under-occupying the accommodation. 

Therefore the following household eligibility will be applied:

2 bed 4 person house:

Properties advertised in the first instance to:

  • Single adult, 1 dependent child
  • Couple, 1 child
  • Single/Couple, 2 dependent children who should share
  • Consideration given to the following groups if no applicants with dependent children:
  • Couple (under occupation accepted under this LLP)
  • Single/Couple & 1 adult (where not dependent child or not child of applicants)
  • Non-cohabitating couple (under occupation accepted under this LLP)
  • 3 single adults

3 bed 5 person house:

Properties advertised in the first instance to:

  • Couple, 1 child
  • Single/Couple, 2 dependent children who should share
  • Single/Couple, 2 dependent children who should not share
  • Single/Couple, 3 dependent children
  • Single/Couple, 4+ dependent children
  • Single adult, 1 dependent child (under occupation accepted under this LLP)
  • Consideration given to the following groups if no applicants with dependent children:
  • Couple with 1 dependent child
  • Single/Couple & 3 adults (where not dependent children or children of applicants)
  • Single/Couple & 2 adults (where not dependent children or not the children of applicants)
  • Single/Couple & 1 adult (where not dependent child or not child of applicants)
  • 4+ Single Adults
  • 3 single adults
  • Single + 1 dependent child
  • Couple

If no such person is found in accordance with the above criteria within 6 weeks of a dwelling becoming available for letting then the property can be allocated to:

Any person who satisfies the definition of local need in (a) to (e) above and resides in the adjoining parishes of:

  • Sudbury
  • Somersal Herbert
  • Norbury & Roston
  • Cubley
  • Doveridge

The same eligibility criteria should be applied as that shown above.

If no such person is found in accordance with the above criteria within a further 6 weeks of the dwelling becoming available for letting then the property can be allocated in accordance with the Home Options policy to applicants from all areas.

The additional eligibility criteria will not be applied and the local need connection criteria under the Home-Options Policy will be applied rather than the criteria outlined in (a) to (e) above.
